O.J. Simpson Estate Reverses Vow On Goldman Family Getting 'Zero' From $33 Million Payout​

The lawyer handling O.J. Simpson’s estate is reversing a vow he made earlier to do “everything” he can to keep the families of murder victims Ron Goldman and Nicole Brown Simpson from collecting on a $33.5 million wrongful death judgment. O.J. Simpson, who was famous both as a football player and as an acquitted murder suspect, died last week at the age of 76 from cancer.

After Simpson’s death was announced, Malcolm LaVergne, his attorney and estate executor, told the Las Vegas Review-Journal he wanted to make sure the Goldman family “get zero, nothing.”

However, he has changed his tune. In an interview with The Hollywood Reporter published Monday, LaVergne said that Ron Goldman’s father, Fred Goldman, will have his claim “accepted” and “handled in accordance with Nevada law.” LaVergne admitted to the outlet that his earlier vow was in reaction to comments made by Fred Goldman’s lawyers after Simpson’s death was announced.

“Within an hour of knowing that O.J. died, [Goldman’s lawyer] started talking shit,” LaVergne said. “My advocate instinct is was, ‘Oh, you’re gonna keep shitting on him even after he’s dead? Fine, you know? You get nothing.’” LaVergne added that his initial remarks were “pretty harsh,” but “I backtracked” and “now I’m going in the other direction.” Moving forward, LaVergne plans to be “hypertransparent” with both the Brown Simpson and Goldman families and will invite Ron Goldman’s mother and the person in control of Brown Simpson’s estate to a meeting at his office.

“I’m going to show my homework before I even have to give it to the courts and see what we can do in terms of getting this estate in order,” LaVergne said.

Simpson was put on trial for the June 1994 murders of Goldman and Brown Simpson, his ex-wife, and was acquitted in October 1995. A 1997 civil suit ruled that Simpson was liable for Goldman and Brown Simpson’s deaths. However, the Goldman family has only received less than 1% of the more than $33 million they are owed by the Simpson estate, according to the Los Angeles Times.

The executor of O.J. Simpson's estate has reversed his stance on working to prevent a payout of a $33.5 million judgment awarded by a jury to the families of Simpson's ex-wife Nicole Brown Simpson and her friend Ron Goldman in a wrongful death lawsuit.

Attorney Malcolm LaVergne had told the Las Vegas Review-Journal late last week that his hope was "that the Goldmans get zero, nothing" and that he would "do everything in my capacity as the executor or personal representative to try and ensure that they get nothing."

However, on Monday, in a telephone call to The Hollywood Reporter, LaVergne changed his opinion.

"I can tell you in advance, Fred Goldman's [Ron Goldman's father] claim will be accepted. And his claim will be handled in accordance with Nevada law," LaVergne told The Hollywood Reporter.

Simpson died Wednesday without having paid the lion's share of the civil judgment that was awarded in 1997 after jurors found him liable. With his assets set to go through the probate process, the Goldman and Brown families could be in line to get paid a piece of whatever Simpson left behind.

LaVergne, who had represented Simpson since 2009, said his comments to the Review-Journal were not directed toward Fred Goldman, but instead to the attorneys representing him.

"Within an hour of knowing that O.J. died, he started talking s---. My advocate instinct is was, 'Oh, you're gonna keep s---ting on him even after he's dead?'" he told the publication. "'Fine, you know? You get nothing.' And so, those were my remarks then. But I backtracked, and they were pretty harsh remarks. And now I'm going in the other direction."

Simpson earned fame and fortune through football and show business, but his legacy was forever changed by the June 1994 knife slayings of his ex-wife and Ron Goldman in Los Angeles. He was acquitted of criminal charges in 1995.

Fred Goldman, the lead plaintiff, always said the issue was never the money; it was only about holding Simpson responsible. He said in a statement Thursday that, with Simpson's death, "the hope for true accountability has ended."

The Goldman and Brown families will be on at least equal footing with other creditors and will probably have an even stronger claim, as Simpson's estate is settled under terms established by the trust created in January. The will lists his four children and notes that any beneficiary who seeks to challenge provisions of the will "shall receive, free of trust, one dollar ($1.00) and no more in lieu of any claimed interest in this will or its assets."

LaVergne told The Hollywood Reporter that he will be "hypertransparent" with the families and "show my homework" with them as he tries to get the estate in order.

Simpson said he lived only on his NFL and private pensions. Hundreds of valuable possessions had been seized as part of the jury award, and Simpson was forced to auction off his Heisman Trophy, fetching $230,000.

In his final will, the former NFL star-turned-accused murderer appointed LaVergne as the executor of his estate. Initially, LaVergne asserted that Goldman's family should receive "zero, nothing" from Simpson's estate.

"It's my hope that the Goldmans get zero, nothing. Them specifically," LaVergne said after Simpson passed away. "And I will do everything in my capacity as the executor or personal representative to try and ensure that they get nothing," he added. The estate executor further admitted, "In hindsight, in response to that statement that ‘it’s my hope they get zero, nothing,’ I think that was pretty harsh. Now that I understand my role as the executor and the personal representative, it’s time to tone down the rhetoric and really get down to what my role is as a personal representative. We can get this thing resolved in a calm and dispassionate manner."

Despite being acquitted in the 1994 murder trial Simpson was found liable for both deaths in civil court the following year. According to Page Six, a significant portion of his income was earmarked for settling this substantial debt. However, following his release from prison in 2017 on an unrelated charge, Simpson managed to sustain a comfortable lifestyle by predominantly conducting business transactions in cash, thereby circumventing payments to the Brown and Goldman families.
