Phillip Alpert found out the hard way. He had just turned 18 when he sent a naked photo of his 16-year-old girlfriend, a photo she had taken and sent him, to dozens of her friends and family after an argument. The high school sweethearts had been dating for almost 2½ years. "It was a stupid thing I did because I was upset and tired and it was the middle of the night and I was an immature kid," says Alpert.

Orlando, Florida, police didn't see it that way. Alpert was arrested and charged with sending child pornography, a felony to which he pleaded no contest but was later convicted. He was sentenced to five years probation and required by Florida law to register as a sex offender.

I'm getting fucking tired of these predatory prosecutors getting away with these insane charges against children. There is a reason we have two sets of courts. A couple of things should happen. One: They need to make the threshold very, very high for trying a minor as an adult for ANYTHING. It would have to be seriously egregious in order to do that. Second, the whole sex offender registration needs to be reformed. There is too broad of a brush as to what tars a person for life as a sex offender. Public urination can put you on the list right next to a child rapist. This demeans the seriousness of ACTUAL sex offenders. Third, USE SOME FUCKING COMMON SENSE! A teen taking naked pictures of herself should not be treated as child pornography! The pictures would qualify, but she shouldn't be charged with a crime because of it! So now she'll be labeled for life because of a stupid VICTIMLESS "crime". This needs to be stopped. RIGHT NOW. Interestingly enough, the woman behind the creation of Megan's Law is outraged at this. She blasted the prosecutors in a statement saying that this child need counseling, not legal trouble, and this is not what Megan's law was designed for.
A lot of these predatory prosecutors better be damn glad I'm not a judge. I have a very, very low tolerance for bullshit. If one of these prosecutors brought this nonsense into my courtroom, I'd throw out the case with prejudice, order all fingerprints, mugshots and arrest records destroyed, then I'd fine the prosecutor's office and order them to pay court costs. I'd also tell him/her/it that if they brought that crap into my courtroom again I'd hold them in contempt. Abuse of the law rankles me to no end.

How would the pictures qualify as 'child pornography', you stupid fuck? She's 16 years of age. She gave HERSELF permission to send out the photos, so fuck all.

You should actually READ the article I linked to. The retarded shit-stain that calls itself a prosecutor is charging the girl with "child pornography" for posting naked photos of herself on Myspace. I am liberal as you know but I feel this is the right move. These teens may be just sending naked pics of themselves to other teens but they can easily end up on some perverts laptop someday.

This is not the right move. It's disproportionate. It is not a good thing for a teen to take pictures of themselves and post them on the net. Let me make that clear. However, this is stupidity, NOT criminal. I think this girl and any who do this kind of thing need counseling. Court mandated, fine. I'm OK with that. What they do NOT need is to be charged with a sex crime. Let me explain to you what would happen. A 14 year old girl puts HER picture on the net. She is then charged with CHILD PORNOGRAPHY, and if convicted, can spend up to 17 years in prison! When she gets out, she will be branded for LIFE as a sex offender, and never get into college, and have job options severely limited, along with where she can live. All for posting a picture of HERSELF on the net! You think that's appropriate?! You think that does anyone any good? That is NOT what sex offender laws were designed for! It's a perversion and an abuse of the law. As someone with extended family members who have been sexually abused, I am downright FURIOUS at the way someone making a dumb mistake like this can get them lumped in with child rapists, pedophiles, and ACTUAL child pornographers. This is being used by predatory prosecutors to make a name for themselves, and to push some kind of agenda. This kind of thing makes me sick. And I'm the opposite of you, politically. I'm a hard-right Libertarian. Something needs to be done about this kind of thing, but what these prosecutors are doing is out of line and WRONG.

I fail to see your point. So, the teen makes a nude picture of herself available. Where's the problem? This is a win-win proposition.
