Supreme Court will take up state bans on gender-affirming care for minors​


The Supreme Court jumped into the fight over transgender rights, agreeing to hear an appeal from the Biden administration seeking to block state bans on gender-affirming care. The justices’ action comes as Republican-led states have enacted a variety of restrictions on health care for transgender people, school sports participation, bathroom usage and drag shows. The administration and Democratic-led states have extended protections for transgender people, including a new federal regulation that seeks to protect transgender students. The case before the high count involves a law in Tennessee that restrict puberty blockers and hormone therapy for transgender minors. The federal appeals court in Cincinnati allowed laws in Tennessee and Kentucky to take effect after they had been blocked by lower courts. (The high court did not act on a separate appeal from Kentucky.) “Without this Court’s prompt intervention, transgender youth and their families will remain in limbo, uncertain of whether and where they can access needed medical care,” lawyers for the transgender teens in Tennessee told the justices. Last month, South Carolina became the 25th state to adopt a law restricting or banning gender-affirming medical care for transgender minors, even though such treatments have been available in the United States for more than a decade and are endorsed by major medical associations.

SCOTUS Takes on Trans Kids’ Health in New Culture War Front​


The Supreme Court agreed to weigh whether or not a Tennessee law banning specific gender-affirming care for minors breaches the Constitution, marking the first time that the justices will consider arguments around medical treatments for trans children. The Biden administration is challenging a ruling from a lower court that upheld the state ban on treatments including hormones and surgeries for children who experience gender dysphoria. Other Republican-led states have similarly taken steps to restrict transgender access to healthcare. According to the Goverment petition to the court, the law blocking medical care for trans children violates the 14th Amendment—which mandates that the law should be equally applied to everyone—in part because it “frames that prohibition in explicitly sex-based terms.”

The court is expected to hear oral arguments and make a ruling in its upcoming term, which starts in October and will end in June 2025. The case marks the first time the court, which has a 6-3 conservative majority, will issue a ruling in the battle over transgender rights for teens, which has raged in both the health care and education contexts. "The future of countless transgender youth in this and future generations rests on this Court adhering to the facts, the Constitution and its own modern precedent,” said Chase Strangio, a lawyer at the American Civil Liberties Union, which also challenged the law.

Understanding transgender people, gender identity and gender expression​

Transgender is an umbrella terms for persons whose gender identity, gender expression or behavior does not conform to that typically associated with the sex to which they were assigned at birth.

According to the APA Style guide, the term “transsexual” is largely outdated, but some people identify with it; this term should be used only for an individual who specifically claims it. While the term “transsexual” appears multiple times throughout this document, APA’s Committee on Sexual Orientation and Gender Diversity is undertaking a systematic review of its use along with other terms. In the meantime, please refer to the Guideline for Psychological Practice with Transgender and Gender Nonconforming People for more up-to-date language regarding transgender and gender nonconforming people.
