Mistake costs dishwasher $59,000

MIAMI, Florida (CNN) -- For 11 years, Pedro Zapeta, an illegal immigrant from Guatemala, lived his version of the American dream in Stuart, Florida: washing dishes and living frugally to bring money back to his home country.

Two years ago, Zapeta was ready to return to Guatemala, so he carried a duffel bag filled with $59,000 -- all the cash he had scrimped and saved over the years -- to the Fort Lauderdale-Hollywood International Airport.

But when Zapeta tried to go through airport security, an officer spotted the money in the bag and called U.S. customs officials.

"They asked me how much money I had," Zapeta recalled, speaking to CNN in Spanish.

He told the customs officials $59,000. At that point, U.S. customs seized his money, setting off a two-year struggle for Zapeta to get it back.

Zapeta, who speaks no English, said he didn't know he was running afoul of U.S. law by failing to declare he was carrying more than $10,000 with him. Anyone entering or leaving the country with more than $10,000 has to fill out a one-page form declaring the money to U.S. customs.

Officials initially accused Zapeta of being a courier for the drug trade, but they dropped the allegation once he produced pay stubs from restaurants where he had worked. Zapeta earned $5.50 an hour at most of the places where he washed dishes. When he learned to do more, he got a 25-cent raise.

After customs officials seized the money, they turned Zapeta over to the Immigration and Naturalization Service. The INS released him but began deportation proceedings. For two years, Zapeta has had two attorneys working pro bono: one on his immigration case, the other trying to get his money back.

"They are treating me like a criminal when all I am is a working man," he said.

Zapeta's story became public last year on CNN and in The Palm Beach Post newspaper, prompting well-wishers to give him nearly $10,000 -- money that now sits in a trust.

Robert Gershman, one of Zapeta's attorneys, said federal prosecutors later offered his client a deal: He could take $10,000 of the original cash seized, plus $9,000 in donations as long as he didn't talk publicly and left the country immediately.

Zapeta said, "No." He wanted all his money. He'd earned it, he said.

Now, according to Gershman, the Internal Revenue Service wants access to the donated cash to cover taxes on the donations and on the money Zapeta made as a dishwasher. Zapeta admits he never paid taxes.

CNN contacted the U.S. Attorneys office in Miami, U.S. Customs and the IRS about Zapeta's case. They all declined to comment.

Marisol Zequeira, an immigration lawyer, said illegal immigrants such as Zapeta have few options when dealing with the U.S. government.

"When you are poor, uneducated and illegal, your avenues are cut," he said.

On Wednesday, Zapeta went to immigration court and got more bad news. The judge gave the dishwasher until the end of January to leave the country on his own. He's unlikely to see a penny of his money.

"I am desperate," Zapeta said. "I no longer feel good about this country."

Zapeta said his goal in coming to the United States was to make enough money to buy land in his mountain village and build a home for his mother and sisters. He sent no money back to Guatemala over the years, he said, and planned to bring it all home at once.

At Wednesday's hearing, Zapeta was given official status in the United States -- voluntary departure -- and a signed order from a judge. For the first time, he can work legally in the U.S.

By the end of January, Zapeta may be able to earn enough money to pay for a one-way ticket home so the U.S. government, which seized his $59,000, doesn't have to do so.

So let me get this straight...

Illegal beaner enters country illegally.

Illegal beaner gets a job.

Illegal beaner NEVER pays a dime in taxes.

Illegal beaner decides to go home and gets busted with a duffle bag full of cash.

Illegal beaner gets money confiscated.

Illegal beaner gets attorneys who stall his deportation FOR 2 YEARS to fight for money that illegal beaner earned while preforming an illegal activity and SHOULDN'T hAve to begin with.

Federal government OFFERS illegal beaner some of the money to shut up and go home.

Illegal beaner claims America bad place and he didn't do anything wrong.

Make this dumb fucker walk home. And while you're at it, send his lawyers and the dumb fucks who made the offer in compromise with him. Then raid the businesses he worked for and bitchslap them right into poverty.

The reality is, the company's will never be affected, the beaner will probably get some of the money back, he and the rest of his family will sneak back across the border within the year, and we the tax payers will end up supporting him and his illegal beaner family AND paying the bills for all the government bullshit to date.

I would konk that beaner with a hammer and take that money and buy dope and strippers.

I, for one, am heartbroken that Zapeta no longer feels good about this country. I mean, we were his golden goose, the funding for his land ownership in another country.

He should be fined for the illegal entry, fined for being here illegally, taxed on his earnings because while he was here he benefitted from our tax supported infrastructure and services like roads, bridges and water - and he admitted he never paid taxes which means penalities and fines for non-payment of taxes, and he should be fined for court costs. Then, he can have the remainder of the $59k out of which he can pay for his fare out of here.

I do applaud his work and savings effort - he saved about half of what he earned over 11 years while only making barely minimum wage. I do not applaud his attitude that we are his cash cow, he doesn't have to abide by our laws, pay taxes which contribute to things of ours he uses, or even learn to speak our language in 11 years.

I'd love to see his spreadsheet.

That liar is so full of shit I suspect he floated across the river quite easily on his way over.

Interesting, though. Eleven years labor at approx. $5.50 per hour equals $126,000 minus $59,000 which gives him $66,840 divided by 11 to be approx. $6,076 a year, $506 a month, to live on. Frugal he may have been, but I find it hard to believe he lived a solitary life supporting himself, providing for all of his needs such as food, shelter, medical, and transportation, on such a paltry sum. Zapeta says he didn't pay taxes. I wonder if all the other stuff deducted from our paychecks were also not collected. I wonder if his employers provided his meals, if he often took his meals at a local shelter, or he received some other type of aid to purchase food. I also wonder what kind of assistance he received for his shelter and medical care. Maybe he shared a place to live with a number of other people, in a similar situation, and his rent was really low and he was never sick or injured.

I have mixed feelings over this. I'm sorry he will lose what he has worked and scrimped and saved so long for. But, at the same time, I resent him taking advantage of us. I resent the news making him out to be some poor, sad person who is being taken advantage of by the big bad government. Then, they follow it up with pitiful pictures of his poor mother and sisters crying so pitifully in the hills of Guatemala. Maybe these journalists could provide a balanced perspective on the situation - like how much did Zapeta cost the system supported by the taxpayers of this country and what his contribution was. Might also look into the subculture in this country that allows people like Zapeta to live and work in this country for 11 years and he not pay into the system most of us have to. How would these people who feel like Zapeta is getting ripped off feel if turns out that out of all the people living and working in this country, half of us are paying into the system that many of us find we do not qualify to benefit from the services for the poor and indigent and the poor and indigent that are benefitting are here illegally, saving their dollars to take back to another country? I mean, I'd like to spend my medical care and tax dollars on something else too, like early retirement. Why can't I live for damned near free too and all the other legally working people pay for me to do it? Why, oh why, oh why? I don't feel so good about this country now.

He's a fucking drug mole, and a liar. Every employer that ever hired him should be in jail then too.

Looks like Ron Paul's got the solution to all your beaner woes.

Border Security and Immigration Reform

The talk must stop. We must secure our borders now. A nation without secure borders is no nation at all. It makes no sense to fight terrorists abroad when our own front door is left unlocked. This is my six point plan:

* Physically secure our borders and coastlines. We must do whatever it takes to control entry into our country before we undertake complicated immigration reform proposals.
* Enforce visa rules. Immigration officials must track visa holders and deport anyone who overstays their visa or otherwise violates U.S. law. This is especially important when we recall that a number of 9/11 terrorists had expired visas.
* No amnesty. Estimates suggest that 10 to 20 million people are in our country illegally. That’s a lot of people to reward for breaking our laws.
* No welfare for illegal aliens. Americans have welcomed immigrants who seek opportunity, work hard, and play by the rules. But taxpayers should not pay for illegal immigrants who use hospitals, clinics, schools, roads, and social services.
* End birthright citizenship. As long as illegal immigrants know their children born here will be citizens, the incentive to enter the U.S. illegally will remain strong.
* Pass true immigration reform. The current system is incoherent and unfair. But current reform proposals would allow up to 60 million more immigrants into our country, according to the Heritage Foundation. This is insanity. Legal immigrants from all countries should face the same rules and waiting periods.

Hope for America

Or even better yet, severely punish employers who pay illegals under the table to save a few bucks. I'm sure there are plenty of laws already on the books about that shit.

How hard can it be to enforce laws that already exist? :jayzus:

They're too busy writing traffic tickets to generate revenue.

Besides, we all know that making more laws to cover redundant territory will solve the problem, or at least get candidates with "change" as a platform elected.
