I have a friend that was looking for a new place, her apt. was very nice but she wanted something a little more spacious. I recommended a condo that was for rent in my development and she thought that was a great idea. So I helped her get in touch with the leasing agent and he told her that the condo for rent was in poor condition but that his parents lived in the development and would be renting their condo out in mid June if she wanted to wait.
My friend checked out this guy's parents condo and decided it was great and she would wait until mid June to move...This was back in March mind you. So my friend was keeping in touch with this dude, making sure plans were on track but he was hard to a hold of and when she did he was always reassuring her that everything was going great and things would be ready for her to move in JulyThat was a good thing as she'd already given her current landlord notice and her place had been rented for July 1.
The last week of May my friend was getting antsy about not hearing from this agent so she made a visit to his parent's house to see how things were coming along. The agent just so happened to be there and told her at that time that gee, his cousin is pregnant and so his parents are going to rent to her because you know, family first and all of that. My friend was a little peeved but the agent promised that the other condo would be repaired and ready to rent by her July 1 deadline.
As each week passed my friend found it harder and harder to get a hold of this agent but when she did get a hold of him or he called her back he assured and reassured her that the condo would be repaired and not to worry, it'd be ready for her to move into July 1. I was able to update her and let her know that nothing was being done to the condo as I can see it outside my back patio and though my friend worried the agent kept assuring her everything was on schedule and the condo would be ready.
Last week my friend called the agent and said specifically, "I'm afraid I'm going to be homeless in a week..." To which the agent replied, "I would never let that happen, don't worry." And right up until Wednesday of this week the agent was assuring her the place was going to be ready for her July 1 move. The place needed a lot of work, I saw it when the last tenant moved out so I could not figure out how in 4 days that dump was going to habitable but then I've seen Extreme Home Make Over and if they can build a house in a week maybe a crew could get that place done.
At 10:00AM on Thursday June 28, just two days before my friend was supposed to move she got a message on her cell phone. The agent very nonchalantly informed my friend that gee, fixing the water heater was going to be a problem and nowlegally he couldn't rent to her. The dickweed bottom feeder has known for months my friend wanted the place and had months to take care of the water heater and did NOTHING. Although my friend is sorry she didn't follow her gut weeks earlier the agent was so sincere in his assurences.
So now I'm asking. Should she sue? Can she sue? Should I post his name and E-mail address and let the trolls have a field day? I mean, the girl didn't HAVE to move, her landlords begged her not to move but her mind was made up and she was sure she'd have some place to live come July 1. She bought a few more days from the incoming tenants and is nowfrantically looking for a place but she and her three kids may end up on my couch for a few days. It so sucks for her.
